1. Agreement to Terms
By accessing or using Tontiin, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you disagree with any part of these terms, you may not use our service.
2. Service Description
Tontiin operates as a licensed cooperative financial institution (TONTIIN COOP-CA), registered with the Ministry of Agriculture and Rural Development of Cameroon under certificate N°25/105/CMR/CE/02/10/CCA/036004/036004000. As a licensed cooperative bank, we are authorized to provide comprehensive banking services to our members including:
- Individual and group savings accounts
- Credit facilities and loans to members
- Mobile money payment processing
- Cross-border financial services
- Traditional rotating savings groups (tontines/njangi)
- Microfinance and cooperative banking services
Important: As a licensed cooperative bank, we provide regulated financial services to our members across Africa. While we facilitate group savings operations, group members remain responsible for organizing themselves and ensuring faithful participation in group activities.
3. Payment Terms
3.1 Mobile Money Processing
We process payments through authorized mobile money operators in your country. By using our service, you acknowledge:
- Transaction fees are calculated as a percentage of the transaction amount
- Fees may vary by country and mobile money provider
- Fee structures may change based on mobile money operator policies
- Current fee rates will always be displayed before transaction confirmation
3.2 Transaction Charges
Our fee structure includes:
- Mobile money operator charges (varies by provider)
- Platform service fee (percentage-based)
- Any applicable government taxes
Note: Fee structures may be updated periodically to reflect changes in mobile money operator charges or regulatory requirements.
4. User Responsibilities
- Maintain accurate and up-to-date account information
- Keep login credentials secure
- Honor group commitments and payment schedules
- Verify mobile money account details before transactions
- Report any unauthorized transactions immediately
5. Group Management and Member Responsibilities
5.1 Group Self-Organization
- Groups must establish clear rules and contribution schedules
- All members must consent to group terms
- Group administrators are responsible for member management
- Emergency fund contributions are mandatory if enabled by the group
- Groups are responsible for vetting and selecting trustworthy members
- Members must organize themselves to ensure timely contributions
5.2 Member Default and Non-Contribution
Group members acknowledge and agree that:
- Tontiin is not responsible for members who fail to make contributions
- Groups must handle member defaults through their own internal processes
- Members are responsible for chasing defaulting members and enforcing group rules
- Tontiin provides tools but does not guarantee member compliance or participation
- Groups should establish clear consequences for non-contribution before starting
- Legal action against defaulting members is the responsibility of the group, not Tontiin
6. Platform Limitations and Liability
6.1 Service Scope
Tontiin provides a technology platform to facilitate group savings operations. Our services are limited to:
- Providing software tools for group management
- Processing payments through authorized mobile money operators
- Maintaining transaction records and group communication features
- Charging service fees for platform usage
6.2 What We Do NOT Guarantee
Tontiin explicitly does not:
- Guarantee that group members will make their contributions
- Act as a guarantor or insurer for member defaults
- Mediate disputes between group members regarding contributions
- Enforce group rules or chase defaulting members
- Provide legal recourse for member non-participation
- Compensate groups for losses due to member defaults
6.3 Member Acknowledgment
By using Tontiin, all users acknowledge that:
- Group participation is based on trust between members
- Tontiin's role is limited to providing technology services
- Members assume full responsibility for vetting and managing their groups
- Any losses due to member defaults are not Tontiin's responsibility
7. Dispute Resolution
In case of disputes:
- First attempt resolution within the group
- Contact Tontiin support for technical issues only
- We maintain transaction records for technical dispute resolution
- Member contribution disputes must be resolved between group members
- Legal action regarding member defaults is between group members, not involving Tontiin
8. Termination
We reserve the right to terminate or suspend accounts for:
- Violation of these terms
- Fraudulent activity
- Non-payment of obligations
- Disruptive behavior in groups
9. Anti-Money Laundering (AML) and Know Your Customer (KYC)
In compliance with COBAC regulations, Cameroon's financial laws, and CEMAC Anti-Money Laundering Regulation No. 01/16/CEMAC/UMAC/CM, we implement strict AML and KYC procedures:
9.1 Identity Verification
- Users must provide valid government-issued identification
- Proof of address not older than 3 months
- Additional documentation may be required based on transaction volumes
- Regular verification updates may be required
- Business users must provide business registration documents and beneficial ownership information
9.2 Transaction Monitoring
- All transactions are monitored for suspicious activity
- Transaction limits apply based on verification level
- Large transactions require additional verification
- We report suspicious activities to ANIF (National Financial Investigation Agency)
- Enhanced due diligence for high-risk transactions
9.3 Prohibited Activities
- Money laundering or terrorist financing
- Providing false or misleading information
- Using the service on behalf of others without proper authorization
- Any activities violating Cameroon's financial regulations
- Transactions with sanctioned individuals or entities
- Circumvention of transaction monitoring systems
9.4 Compliance Requirements
- Users must comply with all AML/KYC requests within specified timeframes
- Failure to comply may result in account suspension
- We maintain records as required by COBAC regulations
- Users consent to information sharing with regulatory authorities
- Regular updates of KYC information as required by law
10. Sanctions and Legal Consequences
Violations of these terms, particularly those related to AML/KYC requirements, may result in:
10.1 Platform Sanctions
- Immediate suspension or termination of account access
- Freezing of funds pending investigation
- Permanent ban from using Tontiin services
- Forfeiture of accumulated benefits or rewards
10.2 Legal Consequences
- Reporting to ANIF and other relevant authorities
- Criminal prosecution under Cameroonian law
- Fines and penalties as prescribed by CEMAC regulations
- Civil legal action for damages
10.3 Reporting Obligations
- We are legally obligated to report suspicious transactions
- No prior notice will be given for regulatory reporting
- Users cannot be informed of ongoing investigations
- Cooperation with law enforcement is mandatory
